Terms and conditions of the services provided by Travelwith.pl
§ 1
Preliminary provisions
1. Travelwith services are available at travelwith.pl, provided by the Travelwith company, with its registered office in Switzerland.
2. The terms and conditions are addressed to the Clients and they define the terms and conditions of concluding a service contract for electronically supplied services via the Service.
§ 2
Terms
1. Service provider – natural person conducting economic activity as the Travelwith company, Marta Ławro-Skrzyńska.
2. Client – any subject purchasing services via the travelwith.pl website.
3. Service – the travelwith.pl website.
4. Remote contract – agreement concluded with the Client within the framework of Organized distance contracting system (within the Service), without simultaneous physical presence of parties, with exclusive use of one or more means of distance communication until the conclusion of the contract.
5. Terms and conditions – the terms and conditions of the Service.
6. Order – a declaration of will of a Client made by means of an Order Form and aimed directly at concluding a service contract with the service supplier.
7. “Order” option – an interactive icon available at the Service allowing to place an Order.
8. Order form – a form containing the personal data of a client placing an Order.
9. Service – the subject of a Service contract between a Client and the Service provider, available within the Service.
10. Service contract – contract for services between a Client and the Service provider concluded via the Service.
§ 3

3. Clients may contact the Service provider using the contact details stated in this paragraph.
4. Clients may contact the Service provider via telephone between 10.00 a.m. and 18.00.
§ 4
General information
1. All prices listed in the table are in EUR and include all taxes.
2. Detailed information regarding payment methods can be found in the Service.
§ 5
Terms and conditions for placing an order
To place an order a Client needs to:
1. Use the Service.
2. Select a service which is the subject of the Order, and then click on the “Order” icon.
3. Complete the Order form by entering his/her data.
4. Confirm the Order by clicking on the link sent by an e-mail message.
5. Select one of the available payment methods and depending on the selected method, pay for the Order within the time limit.
§ 6
Performance of the Service contract
1. Service provider is concluded after the Client places an Order via the Order form via the Service website in accordance with § 5 of Terms and conditions.
2. After an Order is placed, the Service provider immediately confirms receiving the Order, and simultaneously accepts the Order for completion. An Order confirmation and information about its acceptance for completion are sent by the Service provider to the e-email address given by the Client with Order placement. This message contains at least the confirmation of the Service provider that the Order has been received and accepted for completion, and a confirmation that the Service contract has been concluded.
3. As soon as the Client receives the above-mentioned e-mail message, Service contract is concluded between the Client and the Service Provider.
4. In reference to the Service contract, the Client has no right to withdraw from the Contract if the Service provider has fully performed the Service at the Client’s expressed consent, who has been informed prior to the commencement of the service that when the service is performed, he/she loses their right to withdraw from the Contract.
§ 7
Personal data in the Service
1. The Service provider is the data administrator of the Clients’ data, collected via the online Service.
2. Personal data of the Clients collected by the administrator via the Service is collected in order to perform the Service contract, and if the Client gives their consent – also for marketing purposes.
3. Possible recipients of the Client’s personal information include:
1. Payment processing agents for the Service,
2. Agents dealing with data analysis and profiling, i.e. Google, Facebook.
4. The Client has the right to request access to and rectification or erasure of their personal data.
5. The provision of the Client’s personal data is voluntary, however, not providing the personal data necessary for concluding the Service contract detailed in Terms and conditions will result in the inability to conclude this contract.
§ 8
Final provisions
1. Service contracts concluded via the Service are in English.
2. Service provider reserves the right to change the contents of Terms and conditions for important reasons, i.e.: legislature changes, payment methods changes (to such an extent as these changes affect the completion of the provisions included in Terms and conditions). The Client will be informed about any changes with at least a 7-day notice.
3. For matters not governed by the provisions of Terms and conditions Polish rules apply, in particular: Civil code, Law of Provision of Electronic Services, Consumer Law, Personal Data Protection Act.
4. The Client has the right to use out-of-court complaint processing and redress of claims. In order to do it, the Client can submit a complaint through the ODR portal available at: http://ec.europa.eu/consumers/odr/.
